Improper Wage Statements

Employees are entitled to a proper wage statement that contains the required information (e.g., wages earned, hours worked, deductions, hourly rates) to verify that they are being properly paid.

If the employer fails to provide a proper and accurate wage statement, the employee can sue for substantial damages and penalties under various Labor Code provisions, including sections 226(e)(1) and 226.3 of the California Labor Code.

In California, an employer is required to provide employees with regular written wage statements that accurately state, among other things:

  • Gross and net wages earned
  • Total hours worked;
  • All deductions;
  • The dates of the pay period;
  • The name of the employee with either an employee identification number or the last four digits of their social security number;
  • The name and legal address of the employer; and
  • All applicable hourly rates and the corresponding number of hours worked at each hourly rate. (California Labor Code section 226(a))
